- GENERAL PROVISIONS
• This regulation sets the rules for using the wholesale store, including placing orders for products available in the store, delivery of ordered products to the buyer, payment for products, the buyer’s right to cancel the order and withdraw from the contract, as well as the rules for submitting and processing complaints.
• The wholesale store sells outlet clothing directly at the STOCK HURT headquarters, via phone, email, WhatsApp, Messenger, Telegram, or a form on the website www.stockhurt.com.
• Sales are conducted within the European Union and outside its borders.
Definitions:
• Seller — STOCK-HURT PAWEŁ ŁEPKOWSKI, JAKUB GORYCA LIMITED PARTNERSHIP, ul. PPOR. MIECZYSŁAWA MAJDZIKA 13/-, 32-050 SKAWINA, MAŁOPOLSKIE, NIP: 6772384995, REGON: 360443187
• Buyer — any domestic or foreign entity conducting business or an individual who has concluded or intends to conclude a sales contract with the Seller according to the rules outlined in this regulation.
• Goods — products offered by the Seller.
• Sale — an agreement regarding wholesale sale of goods offered by the Seller, concluded between the Seller and the Buyer based on these regulations.
- USING THE SERVICE
• Account registration is done by completing a registration form. Each form is subject to verification by the website administrator, who may accept or reject the registration without providing a reason. The account verification time may range from a few hours to a few days.
• Logging into the service is done by entering the username and password.
• A registered user can use all service functionalities, including placing orders for products.
• Having an account is not a necessary condition to place an order. The condition is familiarizing oneself with the regulations and accepting them before placing an order.
• The wholesale store may block the Buyer’s account in case of a legal violation. Information about the intended account block will be sent to the provided email address. Blocking the account means immediate termination of the contract.
• The Buyer is required to keep their login information confidential. The Buyer is responsible for actions resulting from the use of their account.
- PRODUCT INFORMATION
• All prices on the website www.stockhurt.com and those provided by phone or email are net prices and do not include VAT.
• Outlet goods may have characteristic features, such as a lack of complete information about the contents of the pallets, which does not constitute a basis for complaints.
• Products are divided into categories:
- Grade A — usually new products, without defects, with an acceptable percentage of defects up to 10%.
- Grade B — products with defects, such as missing buttons, broken zippers, stains, missing labels, holes, etc.
- Grade C — products that do not meet full quality standards, may have minor defects (e.g. small damages, material defects), or are older but still fit for sale.
• The photos and videos presented are for illustrative purposes and may differ from the actual products.
• The goods are original and come from legal sources, but the Seller is not an official representative of the brands being sold.
• Products may be marked with manufacturer’s security tags, which will not be removed by the Seller (e.g. clips).
• The wholesale store reserves the right to withdraw individual products from sale.
• The preparation of packages and sorting of clothing is recorded on electronic media.
- PURCHASE CONDITIONS
• Orders are processed based on the availability of goods. If some items are out of stock, the Buyer will be informed about the options for order fulfillment.
• Orders can be placed in person at the company’s headquarters, by phone, email, or via communication platforms such as WhatsApp, Messenger, Telegram, or on social media platforms like Facebook, Instagram, TikTok.
• Each shipment includes a proof of purchase in electronic form.
• Reservation of goods is possible after payment of a deposit of 20% of the total order value. Failure to pick up the goods within 7 days results in the loss of the deposit.
• Placing an order by the Buyer means making an offer to the Seller to conclude a sales contract for the ordered goods.
• Goods reservation occurs after payment is credited to the Seller’s account.
- ORDER FULFILLMENT
• Goods are shipped within 1-3 business days from the receipt of payment in the company’s bank account.
• Delivery costs are covered by the Buyer.
• The Seller is not responsible for delays caused by the courier company or for damages that occur during transport.
• The risk related to the order passes to the Buyer when the goods are handed over to the carrier.
• In case of providing an incorrect delivery address, any additional costs are borne by the Buyer.
- PAYMENT METHODS
• Prepayment to the bank account according to the invoice.
• Payment in cash or by card at the company’s headquarters.
- RETURNS AND EXCHANGES
• Outlet products are sold without a warranty. No returns or exchanges are possible.
• The wholesale store does not guarantee the presence of labels on all products.
- COMPLAINTS
• Due to the nature of outlet goods, complaints regarding non-performance of the sales contract will be considered only if the complaint is submitted within two business days from the receipt of the shipment.
• In case of receiving goods not in accordance with the order, the Buyer has the right to file a complaint in writing or by email. The Seller will respond to the complaint within 14 days from its receipt.
• Complaints related to transport damages should be directed directly to the carrier.
- FINAL PROVISIONS
• The regulations come into force on the day they are announced on the Seller’s website and apply indefinitely.
• The regulations comply with the GPSR provisions regarding product safety introduced to the European Union market:
• The Seller ensures that the offered products meet the safety requirements specified in the regulation.
• The wholesale store monitors complaint submissions and cases of non-compliance.
• In case of identified risks, the seller is obliged to inform the relevant supervisory authorities.
• Products are properly labeled according to the applicable regulations.
• The Seller reserves the right to change the regulations. Buyers will be informed about the changes by email or through publication on the website. Changes do not affect orders placed before their introduction.
• In matters not regulated by the regulations, Polish law applies.
• Buyers who resell goods are required to mark them correctly according to applicable regulations.
• The website administrator is not responsible for any errors or damages resulting from the use of the service.
